I want my motherfucking penguin back.
I'm pissed. Me and DA got into a fight yesterday regarding my wallpaper Tuxism, depicting the popular linux logo Tux the penguin. Apparently, US and International copyright law isn't enough for deviantart, who says I'll need permission from Tux 2.0's creator to use the image on the site.
His site at
[link] says explicityly that the image can be used for any reason and that people should credit him and The Gimp if they ask.
By this logic, you can not make any art depicting the american flag without permission from the government. No depiction of religious symbols without permission from the church, and no pictures of a building without permission from the building owner and the architect. Unbelieveable.
Here's the kicker. I did a search on DA for linux themed stuff. The only thing I found that even remotely resembles something that fits their qualifications is a guy that said he re-traced TUX. Apparently, at Deviant Art ret-racing is equal to creating something of your own. I also came about numerous TUX wallpapers, avatars, as well as other linux sybols (Debian, Gnome, Fedora, etc) NONE of whitch were considered infringements.
Bottom line, this is bullshit. Perhaps I'll get permission to use tux in my wallpapers, perhaps I'll win the lotto and buy out DA just out of spite. Perhaps I'll do nothing. I'm undecided.
